Terms of Service
These Terms of Service (the “Terms”) govern access to and use of RELA (the “Service”) by users outside Japan who use the Service in English, including users in the United States. Users residing in Japan are governed by the Japanese Terms of Service. If you are unsure which terms apply, contact us before using the Service.
The Service is provided by GOONER CO., LTD. (株式会社Gooner), a company incorporated in Japan (“GOONER,” “we,” “us,” or “our”). By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Important: Sections 5 through 8 describe paid subscriptions, automatic renewal, the free trial, Coins, cancellation, and refunds. Review those Sections before making a purchase.
1. Scope
These Terms apply to the relationship between you and GOONER concerning the Service. Purchase screens, feature-specific notices, and other terms presented within the Service form part of these Terms. For a particular feature or transaction, clearly presented transaction-specific terms control if they conflict with these Terms.
2. The Service and Its Nature
RELA is an entertainment and self-understanding service. It uses AI and other technologies to analyze information you enter or upload and provides relationship-related reference information, self-insight, divination-style readings, suggested replies, reports, images, and other content. The Service is offered as a web app and an Android app.
Results are generated from AI inferences, statistical analysis, and divinatory interpretations. They are possibilities and reference information only. They do not determine or guarantee facts, another person's feelings, affection, intentions, future events, health, lifespan, or any other outcome.
The Service does not provide medical, psychological, legal, financial, or other professional diagnosis or advice. You remain responsible for your decisions and actions.
3. Accounts
You must provide accurate information and keep it current. You are responsible for your account and credentials and may not transfer, lend, or share them. You may not create or use multiple accounts to obtain duplicate trials or for another improper purpose. Notify us promptly if you become aware of unauthorized access.
4. Eligibility and Minors
You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. The Service is not directed to children under 13, and children under 13 may not use it.
You must be at least 18 years old, or the age of majority where you live, to purchase a subscription or Coins.
5. Fees, Billing, Automatic Renewal, and Cancellation
Prices, plan features, and sales conditions are displayed in the Service and in our Legal Notice & Subscription Terms. Web prices are stated in U.S. dollars. Applicable sales or use taxes may be added and displayed at checkout. Your bank or card issuer may impose currency-conversion or foreign-transaction fees; those fees are not charged or controlled by GOONER.
Web purchases are processed by Stripe. Android purchases may be processed through Google Play. We do not currently sell the Service through the Apple App Store; on iPhone and iPad, RELA is used in a browser.
Automatic renewal. Paid plans are monthly subscriptions and renew automatically at the then-current disclosed price until canceled. The payment method on file is charged on each renewal date.
Cancellation. To avoid the next charge, complete cancellation at least 24 hours before the next renewal date. Web subscriptions must be canceled through the Stripe billing portal linked from the Plan screen or purchase confirmation email. Selecting the Free plan by itself does not cancel an active subscription. Android subscriptions must be canceled through Google Play under Payments & subscriptions.
After cancellation, paid access continues until the end of the current paid period unless otherwise stated at the time of cancellation. No prorated refund is provided for unused time except where required by law.
Price changes. We will provide at least 30 days' advance notice of a subscription price change and obtain consent where required by law. You may cancel before the new price takes effect.
We will provide renewal notices or reminders where required by applicable law.
6. Free Trial
The Standard plan includes one three-day free trial per person and account for eligible first-time users. A payment method is required to start an automatically renewing trial. Prior users, re-registered users, and duplicate accounts may be ineligible.
Unless you cancel at least 24 hours before the trial ends, the trial converts to the Standard plan at US$9.99 per month plus applicable tax, and renews automatically each month until canceled. The trial end date and first billing date will be shown before confirmation and in the account or confirmation message.
7. RELA Coins
RELA Coins (“Coins”) may be used only for eligible features within the Service. Coins may not be transferred, sold, exchanged for cash, or used outside the Service, and have no cash value.
Coins do not expire while your account remains active. If you delete your account, unused purchased and free Coins are forfeited without refund except where required by law. If we permanently discontinue the Service, free Coins are forfeited, and purchased unused Coins will be refunded or otherwise handled as required by applicable law.
Coin purchases are non-refundable after delivery or use, except for duplicate charges, billing errors, non-delivery attributable to us, or where required by law.
8. Refunds
Subscriptions and Coins are digital services made available immediately. Purchases are final and non-refundable, including partially used subscription periods, except for duplicate charges, billing errors, non-delivery attributable to us, refunds expressly offered at purchase, or refunds required by applicable law.
To request review of a charge, email info@gooner-info.co.jp with your account email and transaction details. Google Play purchases are also subject to Google Play's applicable billing and refund rules.
9. Your Content and Information About Other People
Before entering or uploading chat screenshots, photos, profiles, or other information about another person, you must obtain that person's consent. Where possible, mask names, addresses, phone numbers, employers, account numbers, and other directly identifying information.
Do not enter or upload sensitive information such as race or ethnicity, religious or philosophical beliefs, medical history, physical or mental disability, sex life or sexual orientation, criminal history, precise geolocation, financial account details, government identification numbers, or authentication credentials.
You represent that you possess all rights and consents necessary for your content and that it does not violate law or infringe another person's copyright, likeness, privacy, publicity, confidentiality, or other rights. We may remove suspected unlawful or infringing content. You may delete information about other people that you registered in the Service.
10. License to Your Content
You grant GOONER a non-exclusive, worldwide, royalty-free license to use, reproduce, convert, store, and transmit your content only as necessary to operate the Service, perform requested AI analysis, display results, maintain security, and troubleshoot. We do not use your content for advertising or unrelated purposes, and we do not use it to train foundation models.
11. AI-Generated Content
You may use generated images, text, and reports for personal purposes and may share them on social media. Contact us before commercial use. We do not warrant that generated content is accurate, non-infringing, or suitable for a particular purpose. Review it before relying on, using, or publishing it.
12. Prohibited Conduct
You may not use the Service to:
- violate law, public order, or another person's rights;
- impersonate, stalk, harass, threaten, discriminate against, defame, or unlawfully monitor another person;
- upload content without required rights or consent;
- gain unauthorized access, reverse engineer, scrape, disrupt, or impose excessive load on the Service or another system;
- resell or commercially exploit the Service or generated content without permission;
- engage with organized crime or similar anti-social forces; or
- engage in other conduct reasonably determined to threaten the lawful, secure, or reliable operation of the Service.
13. Suspension and Account Termination
We may restrict, suspend, or terminate access if you violate these Terms, misuse the Service, fail to pay, create a security risk, or if action is otherwise reasonably necessary to protect users or operate the Service. Where practicable and not urgent, we will provide notice and a reason.
14. Account Deletion
You may request account deletion through Settings. If you have an active subscription, cancel it through Stripe or Google Play first. We may delay account deletion until cancellation is confirmed. Account data is then deleted or anonymized as described in the Privacy Policy. Account deletion does not create a right to a prorated refund, and unused Coins are handled under Section 7.
15. Changes, Interruptions, and Discontinuation
We may modify or temporarily suspend the Service for maintenance, outages, security, disasters, changes in law or third-party services, or other operational reasons. Except in emergencies, we will provide reasonable notice of material interruptions or permanent discontinuation. Active subscriptions, purchased unused Coins, and user data will be handled under these Terms, the Legal Notice, the Privacy Policy, and applicable law.
16. Intellectual Property
The Service, software, design, logos, and other materials are owned by GOONER or its licensors. Except for the limited rights expressly granted in these Terms, no intellectual property rights are transferred to you.
17. Disclaimer of Warranties
THE SERVICE AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, GOONER DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY RESULT WILL BE ACCURATE OR RELIABLE. THESE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED IN YOUR JURISDICTION.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GOONER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GOONER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID DIRECTLY TO GOONER DURING THE ONE MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$10.
These limitations do not apply to our willful misconduct or gross negligence, personal injury or death caused by us where liability cannot be excluded, or any other liability or consumer right that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions or limits, so some provisions may not apply to you.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify GOONER and its officers, employees, and contractors against third-party claims and reasonable costs caused by your unlawful content, your material breach of these Terms, or your infringement of another person's rights. This Section does not require indemnification for losses caused by GOONER's own wrongful conduct.
20. Governing Law and Disputes
Before filing a formal claim, contact info@gooner-info.co.jp and allow 30 days for a good-faith attempt to resolve the matter, unless immediate action is reasonably necessary or applicable law provides otherwise.
These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to mandatory law, the Tokyo District Court or Tokyo Summary Court, Japan, will have exclusive jurisdiction as the court of first instance.
Nothing in these Terms deprives a consumer of mandatory protections under the law of the state or country where the consumer resides, including any non-waivable right to bring a claim in a competent local or small-claims court. These Terms do not require arbitration.
21. Google Play
If you obtain or purchase the Service through Google Play, these Terms are between you and GOONER. Google is not a party and has no warranty or support obligations for the Service. Google Play's applicable billing, cancellation, and refund rules control where they apply.
22. Changes to These Terms
We may update these Terms as permitted by law. We will announce material changes and their effective date within the Service, by email, or by another appropriate method. For material changes to price, core features, recurring billing, or user rights, we will provide advance notice and obtain consent where required. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
23. California Consumer Notice
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. The Service is provided by GOONER CO., LTD., 5-12-7-107 Roppongi, Minato-ku, Tokyo 106-0032, Japan, info@gooner-info.co.jp.
24. General
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of relevant assets. For users governed by this English version, this English version controls over a translation to the extent permitted by law.
